Dallas CityCode The Code, as in the beginning available in 1960, comprised of two loose-leaf volumes and comprised the first interpretation and codification of the ecumenical ordinances of the City of Dallas since 1941. With the 1978 impressing, the original two volumes were elaborated by adding Chapter 51, the City's districting Ordinance. A third loose-leaf volume was appended that contained the City's structure codes. When reissued in 1990, the Code was altogether recodified, reformatted, repaginated, and reindexed.
The 1990 Code comprised of three loose-leaf volumes -- Volumes I and II contained Chapters 1 through 50 and Volume III comprised Chapter 51A, "Part II of the Dallas Development Code." The structure codes and Chapter 51, "Part I of the Dallas Development Code," were usable for purchase separately.
With this 1997 publishing, the Code has been entirely repaginated to bump off excess pages and has been changed over to a computer arrange and font that will alleviate the Code’s sustainment by the City Attorney’s Office. This 1997 Code still comprises of three loose-leaf volumes -- Volumes I and II contain Chapters 1 through 50, leave off for Chapter 16, and Volume III contains Chapter 51A. The expression codes and Chapter 51, "Part I of the Dallas Development Code,” may be bought on an individual basis from the Building Inspection Division of the city. Chapter 16, "Dallas Fire Code,” may be bought separately from the Dallas Fire Department.
This Code comprises ordinances passed or efficacious through May 31, 1997. Supplements will be issued sporadically so that copies of the Code may be kept up-to-date. It is foreboded that the supplements will be published every quarter. All volumes of the Code, except the expression codes and the fire code, and all ordinances ameliorating the Code will be maintained on a word processing system in the City Attorney's Office. Adoption of Code This Code of Civil and Criminal Ordinances has been punctually embraced by the regularizing body of the City of Dallas this the 6th day of February, 1961, in the manner commanded by law and is, hereby documented as the Code of Civil and Criminal Ordinances of the City of Dallas, and becomes efficacious as provided in the Adopting Ordinance on the 1st day of March, 1961.
General Provisions: How the Code is designed SEC. 1-1. HOW CODE DESIGNATED AND CITED. The ordinances comprehended in the code and all the other sections shall comprise and are designated "The Revised Code of Civil and Criminal Ordinances of the City of Dallas" and might be so cited. Such code may also be adduced as the "Dallas CityCode ."
SEC. 1-2. PROVISIONS CONSIDERED AS CONTINUATION OF EXISTING ORDINANCES. The provisions seeming in this code and all the other sections, so far as they are the same as those of ordinances to be had at the time of the adoption of "The Revised Code of Civil and Criminal Ordinances of the City of Dallas", shall be well thought-out as a continuation thereof and not as new enactments.
SEC. 1-3. CATCHLINES OF SECTIONS The catch lines of the quite a few sections of the code in black and white in boldface type are proposed as mere catchwords to point toward the contents of the section and shall not be viewed as or taken to be titles of such sections, nor as any part of the section, nor, unless with specific intentions so furnished, shall they be so viewed as when any of such sections, including the catchlines, are bettered or re-enacted.
SEC. 1-5. RULES OF CONSTRUCTION In the building of this code, and of all ordinances and resolutions passed by the city council, the accompanying rules contained in this section shall be ascertained, unless such construction would be discrepant with the manifest intent of the council:
BOND: When a bond is required, an undertaking in writing is comfortable if in good order drafted and executed. CITY: The words "city," "the city," or "this city" entail the city of Dallas, Texas.
CODE: The words "the code" or "this code" shall imply "The Revised Code of Civil and Criminal Ordinances of the City of Dallas."
CONVICTION signifies a conviction in a federal court or a court of any state or foreign nation or political subdivision of a state or foreign nation that has not been reversed, vacated, or pardoned.
COUNCI The words "the council" or "the city council" shall signify the mayor and councilmen acting as the city council of Dallas, Texas.
COUNTY The word "county" shall entail Dallas County, Texas.
DALLAS DEVELOPMENT CODE The words "Dallas Development Code" entail Chapters 51, 51A, and 51P.
GENDER A word spelling the masculine gender only shall broaden and be enforced to include females and to firms, partnerships and corporations as well as to males.
HIGHWAY The term "highway", when used in this code, shall admit any street, alley, highway, avenue or public place or bridges, overpasses, square, tunnels, underpasses, viaducts, and causeways in the city, consecrated or devoted to public use.
JOINT AUTHORITY Words purporting to give authority to 3 or more officers or other persons shall be interpreted as giving such authority to a majority of such officers or other persons, unless it is otherwise declared. MONTH The word "month" shall imply a calendar month.
NUMBER Any word importing the singular number shall admit the plural, and any word importing the plural number shall include the singular.
OFFICIAL TIME STANDARD Whenever certain hours are brought up in this code, they shall mean Standard Time or Daylight Saving Time, as may be in current use in the city. OR, AND: "Or" may be read "and", and "and" may be read "or", if the sense commands it.
OWNER The word "owner", enforced to a building or land, shall admit any part owner, joint owner, tenant in common, tenant in partnership, joint renter or tenant by the entirety, of the whole or of a part of such building or land.
PERSON The word "person" shall extend and be enforced to associations, corporations, firms, partnerships and bodies politic and corporate as well as to individuals. PERSONAL PROPERTY The words "personal property" admit every species of property, except real property, as delineated in this section. PRECEDING FOLLOWING The words "preceding" and "following" entail next before and next after, respectively. PROPERTY The word "property" admits real and personal property. REAL PROPERTY The words "real property" let in land, tenements and hereditaments. ROADWAY The word "roadway" shall entail that portion of a street ameliorated, designed or normally used for vehicular traffic and that portion of a street used for drainage. SIDEWALK The word "sidewalk" shall entail any portion of the street between the curb or the lateral line of the roadway and the adjacent property line, all or a part of which is designated for the use of pedestrians. SIDEWALK AREA The space between the lateral line of the roadway and the boundary separating the public right-of-way and the adjacent private property. SIGNATURE or SUBSCRIPTION The words "signature" or "subscription" shall admit a mark when a person cannot write. STATE The words "the state" or "this state" shall be interpreted to mean the State of Texas. STREET. The term "street" shall let in any highway, boulevard, alley, street, avenue or public place or bridges, square, culverts, underpasses, overpasses, tunnels, viaducts, and causeways in the city, dedicated or devoted to public use. WRITTEN or IN WRITING. The words "written" or "in writing" shall be interpreted to include any representation other than oral of words, letters or figures, whether by printing or otherwise. YEAR The word "year" shall entail a calendar year.
