Car rental agreement terms and conditions
The car is delivered to us in fine operating condition and with the seal of the odometer unbroken.We agree to return the car in the same condition except for ordinary wear and tear along with all tools, tyres, trimmings and equipment to the location on the date specified or earlier, if demanded by the company. The company may take control of the car without demand and at our expense, if it is illegally parked, exploited in violation of the law or of the agreement or if it is in fact abandoned. If the seal of the odometer is wrecked the persons responsible must be reported to the appropriate authority and we are responsible for extra charges based on 500 kilometers per day at 50c per kilometer. We must inform the company if we want to extend the time or if the car has been stolen.
Illegal & Prohibited Use
Individuals who should not drive the hired car:
1. An individual who is not identified in the agreement.
2. An individual who is not licensed for that class of car.
3. An individual whose blood alcohol concentration exceeds the lawful percentage.
4. An individual who has given or for whom we have given a false name, age, address or driver's license details.
5. An individual, whose driver's license has been cancelled, authorized or suspended within the last three years.
6. An individual who has held a driver's license for less than two years. Situations in which and/or for which the car must not be used:
7. Outside the area of use restrictions shown in the agreement.
8. On unsealed roads or off road conditions unless allowed by them in writing.
9. To take persons for hire or to carry any combustible, explosive or acidic materials.
10. To push or pull any vehicle, trailer, boat or other object unless the company has allowed such use in writing.
11. To carry any larger load and/or more persons than is legalized.
12. For racing, pace making, reliability trials, rapidity trials, mount climbing or being tested in training for those uses.
13. In a hazardous manner.
14. In breaking of any legislation or rule controlling vehicular traffic or for any unlawful purpose.
Financial
obligations
1. Every hire charges
specified in the agreement.
2. Every charge claimed from the company in respect of parking or any other traffic infringements incurred during the period of hire or until such later time as the car is returned to the company.
3. All loss of or damage to the car including loss of use, legal expenditures, appraisal fees, towing and recovery, storage and company service charges, etc
Loss or Damage Waiver
If we proceed within the terms and conditions of the agreement the company will grant a loss or damage waiver for our benefit in respect of damage to the car or third party damage other than any property owned by us or any friend, relative, associate or passenger or in our physical or legal control.
General Stipulations
a. We have to quickly report any accident or loss involving the car while rented under the agreement to the company location where the car was rented and have to deliver to the company without delay, all summons, complaint or paper in connection to such loss. Obedience with this sub-paragraph does not excuse the hirer from reporting an accident to police or other proper authorities.
b. We have to release and hold harmless the company and its agents and workers from all claims for loss or damage to their personal property, or that any other person left in the car, which is received handled or stored by the company at any time before, during or after this hire period, whether due to the company\\'s inattention or otherwise.
c. The company provides no articulate or implied warranty as to any matter whatever including without limitation the condition of the car and equipment, its merchantability or strength for any particular purpose.
Fuel
The car must be returned with the quantity of fuel equivalent to that at the time of the commencement of the rental. If the car is returned with a lesser amount of fuel the difference will be charged at a rate which may perhaps consist of a service component unless prior preparations have been made and noted on the agreement.
